Guidelines for filing appeals and making written submissions to the board

The Labour Standards Board is an administrative tribunal established pursuant to the Labour Standards Act to hear appeals from decisions or orders of the Labour Standards Officer made pursuant to that Act.

 

The Labour Standards Act sets out the rights and responsibilities of employers and employees who fall under its authority and provides authority to the Labour Standards Officer to make decisions in relation to a large number of matters including, among other things:

  • issuing a permit to increase or average maximum hours that employees may work
  • declaring circumstances to amount to constructive dismissal
  • agreeing to substituted holidays
  • determining whether wages are owing to an employee by an employer

The Board may hold hearings and consider representations by the persons who will be affected by its decisions.

What we do

The Board will make decisions after investigating any matters before it, including holding any hearings and considering submissions from relevant parties as the Board deems necessary. Please note that the Board’s practice is to hold written hearings (i.e. its decisions are based on the parties written submissions) unless the Board determines that an oral hearing is necessary.

 

On an appeal of a wage certificate, the Board may confirm the amount of wages owing stated in the certificate, cancel it, make another certificate with a different amount, or take no further action. The Board may also confirm unpaid certificates that have not been appealed.

 

The Board generally issues its decision within three months after the hearing of an appeal is concluded.

 

The Board may also file confirmed certificates with the Nunavut Court of Justice, and the certificates will become enforceable judgments against the employers (and in some limited circumstances, their directors).

 

The Board may collect money stated in a wage certificate and pay the money to an employee.
